Official Rules, Terms & Conditions VISIT LONDON 2009 “Only In LGBT London” SWEEPSTAKES SWEEPSTAKES IS OPEN TO LEGAL RESIDENTS OF THE UNITED STATES (THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA ONLY AND EXCLUDING PUERTO RICO AND ALL OTHER TERRITORIES AND POSSESSIONS). AS OF 1st  June 2009 ENTRANTS MUST BE 21 YEARS OF AGE OR OLDER AND HAVE INTERNET ACCESS. The Visit London 2009 “Only in  LGBT London” Sweepstakes begins at 9.00am (EST) 15th June  2009 and ends at 12.00pm (EST) 30th April 2010

1. NO PURCHASE NECESSARY. Sponsored by Visit London, 2 More London Riverside, London SE1 2RR, UK. 

2. To Enter: Complete and submit your Visit London 2009 “Only in LGBT London” Sweepstakes online entry form on www.visitlondon.com/competitions/detail/gay_jun09  or on any other website where this sweepstakes offer may be presented, between 9.00am (EST) 15th June 2009 and 12.00pm (EST) 30th April 2010. Only one entry per person/e-mail address permitted. Additional entries will be disqualified. Entries will not be acknowledged by Sponsor. All entrants must have a valid e-mail address. In case of dispute as to identity of winner, entry will be deemed to have been made by the registered user (meeting eligibility criteria) of the e-mail account and, if a prize is won, it will be awarded to the registered user. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or website or to be acting in violation of the Official Rules. 

3. Eligibility: Sweepstakes open to legal residents of the 50 United States and the District of Columbia (excluding Puerto Rico and all other territories and possessions), who, as of 1st June  2009 are 21 years of age or older and have internet access. Employees of Visit London Limited, and its affiliates, subsidiaries, independent judging agency, advertising, promotion, interactive and similar agencies and the immediate families and household members of the above are not eligible to enter or win. 

4. Drawing: Winner will be selected in a random drawing to be held in New York City, New York on or about 15th May 2010 from all valid entries received. Drawing will be conducted by an independent judging agency. The decision of the independent judging agency will be final and binding. Actual odds of winning depend on the number of eligible entries received. Potential winners will be notified by e-mail only, within approximately 10 business days of the drawing. If the potential winner does not respond to email notification within 10 business days of it being sent, an alternate winner will be selected by random drawing. As per article #10 below, Sponsor assumes no responsibility or liability for any delays in delivery or receipt of the notification email by winner, once the email has been sent by Sponsor and has left the Sponsor’s email system. All prize claims are subject to validation by Sponsor. You are not a winner until your entry has been validated. 

5. Prize: There is one prize, consisting of a credit on na.visitlondon.com. Prizes will awarded in the following amounts: - $3,000 USD There will be one prize awarded at the dollar level. The credit may be used to purchase anything that is available for purchase on, or via, na.visitlondon.com, including air from the U.S.A. to London and hotel accommodations in London. All prizes must be received and use completed by the winner by 30th November 2010. Any prize not used within this specified time limit will be forfeited. Winner must choose from among the products and services available on na.visitlondon.com, identifying those she or he wishes to receive as the travel package. Actual purchase will be made by Visit London, or its designated agency, on behalf of prize winner. There is no cash portion of the prize. Any portion of the prize not spent on na.visitlondon.com will not be awarded. Travel must be booked at least 4 weeks in advance. It is the responsibility of the winner and any travel companion(s) of winner to ensure that they hold adequate travel insurance and that they comply with any entry requirements to the United Kingdom (visas, passports, etc.). Approximate Retail Value (ARV) of each prize is the cash amount stated above. Additional costs, if any, resulting from exchange rate fluctuations will be solely the responsibility of the prize winner. All other expenses not expressly stated herein such as transportation to/from the airport, transportation within London, food and beverages, gas surcharges and all other incidental costs are solely the responsibility of the prize winner and any travel companion(s). Sponsor makes no warranty with respect to prizes. Sponsor will report value of prizes as required by law. Prizes are nontransferable and not assignable. All federal, provincial, state and local taxes, airport departure taxes (except as included in your purchase on na.visitlondon.com with your prize award), V.A.T. taxes and/or any other fees or costs connected with the prizes are solely the responsibility of winner. Any visa, travel documentation, travel insurance or health requirements are the sole responsibility of winner and any travel companion(s). Sponsor will not be responsible for any visa restrictions for entry into the UK, and will not incur any extra expense issuing or assisting in the issue of passports or visas. Sponsor is not responsible for cancellation of travel after ticketing. Airline carrier’s and other prize suppliers’ regulations and restrictions apply. Sponsor reserves the right, for any reason in Sponsor’s sole discretion, to substitute the prize or any portion of the prize for a prize of equal or greater value. 

6. Award Use: The prizes must be taken and used in the context of one (1) trip to London. “One trip” is defined as a departure from the winner’s country of residence (which will be either the United States or as required by these Official Rules) to London and the first subsequent return from London to the winner’s country of residence and all activities occurring between the departure date and return date to and from the winner’s country of residence. 

7. Release of Liability: By entering the Sweepstakes, entrants accept and agree to these rules and the decisions of Sponsor, which shall be final. Winner may be required to sign a Winner’s Agreement and Release and return it within 10 business days of notification or prize may be forfeited in its entirety and another winner may be selected. Sponsor and prize suppliers may use winner’s and any travel companion’s names, pictures, likenesses, addresses (city and state) and/or biographical information for advertising, promotional, trade, and/or any other purposes in any and all media now or hereafter known throughout the world in perpetuity (including posting first name and last initial on www.visitlondon.com) for no additional compensation, except where prohibited. Winner and any travel companion(s) shall have no right of approval, no claim to compensation, and no claim (including, without limitation claims based on invasion of privacy, defamation, or right of publicity) arising out of any use, blurring, distortion, illusory effect, alteration, or use in composite form of their names, pictures, likenesses, addresses (city and state/jurisdiction), biographical information, and entry. Winner and any travel companion(s) may be required to execute, have notarized, and return a Release of Liability/Publicity prior to departure; if any travel companion is under the age of majority, parent or legal guardian must execute such Release. Return of prize or notification as undeliverable may result in disqualification and an alternate winner may be selected. Entries and entry information become the property of Sponsor and none will be returned. Neither Sponsor, its affiliated companies, representatives, agents and employees nor any prize supplier, the independent judging agency, their affiliated companies, representatives, agents and employees (“Releasees”) are responsible for any claims, injuries, losses or damages of any kind resulting from participation of any entrant in this sweepstakes and/or acceptance, use, misuse, possession, or loss of the prize by the winner and or any travel companion of the winner, including any travel related thereto. Releasees will not be responsible for stolen, lost or mutilated travel documents, tickets or passes and none will be replaced.

8. Opt-In and Registration Status Entrants will have an opportunity to declare their preference regarding opt-in status for other communications from Visit London partners at all points of signup on visitlondon.com. By opting in to receive third party communications entrants agree that the Sponsor and Visit London travel partners may contact them with further information and/or offers about their travel interests, unless and until entrants opt-out of further such communications from the Sponsor and its travel partners individually. Sponsor may also use any entrant information obtained in this promotional sweepstakes for purposes of conducting such sweepstakes but will not (except as set forth herein) disclose such information externally to third parties, except with agencies that Sponsor may use to help select winners and fulfill prizes. Personal information be subject to the general laws of application in those jurisdictions. All sweepstakes entrants are also automatically registered as members of visitlondon.com. Registration allows for full access to all information, services, features and offers available on visitlondon.com. Regardless of your opt-in status for other email communications you may receive an email from Sponsor confirming your visitlondon.com membership registration status. 

9. Legal Requirements: All federal, provincial, state and local laws and regulations apply. Void where prohibited, taxed or restricted by law. 

10. General: Sponsor assumes no responsibility for computer system, phone line, hardware, software or program malfunctions or other errors/failures of any kind, delayed computer transmissions or network connections. Sponsor reserves the right in its sole discretion, to cancel, modify or suspend this Sweepstakes should any virus, bug or other causes beyond Sponsor's control corrupt or impair the administration, security, fairness or proper play of the Sweepstakes. Sponsor is not responsible for incorrect or inaccurate entry information whether caused by internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human errors that may occur in the processing of the entries in the Sweepstakes. Sponsor reserves the right to withdraw the transmission of this Sweepstakes at any time and award prize from among eligible non-suspect entries received prior to date of the withdrawal. Caution: Any attempt by any person to deliberately damage any website or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent of the law. 

11. Winners List: Obtain a winners list by sending a self-addressed, stamped envelope to Visit London 2009 “Only in LGBT London” Sweepstakes Winners c/o Long Haul Marketing Manager, 2 More London Riverside, London SE1 2RR, UK. Vermont residents may omit return postage. 

12. Governing Law/Arbitration: THE SWEEPSTAKES SHALL BE GOVERNED BY THE LAWS OF THE STATE OF NEW YORK WITHOUT REGARD FOR CHOICE OF LAWS OR CONFLICTS OF LAWS PRINCIPLES THAT WOULD INDICATE THE APPLICATION OF THE LAWS OF ANY OTHER JURISDICTION. Except where prohibited by law, by registering, each entrant also agrees that any and all disputes that he/she may have with, or claims he/she may have against Releasees relating to, arising out of or connected in any way with the Sweepstakes will be resolved individually and exclusively by final and binding arbitration administered by the American Arbitration Association (the "AAA") and conducted before a sole arbitrator pursuant to the Code of Procedure established by the AAA. The arbitration shall be held in the City and County of New York, New York and shall be subject to the governing law provision set forth herein. The arbitrator’s decision shall be controlled by the terms and conditions of these Official Rules. There shall be no authority for any claims to be arbitrated on a class or representative basis; arbitration can decide only participant’s and/or the Releasees’ individual claims and the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated. The arbitrator shall not have the power to award special, consequential, incidental, exemplary, punitive or other similar damages against the Releasees. Notwithstanding anything contained herein to the contrary, the Releasees may seek to obtain injunctive relief in any of the federal or state courts located in the City and County of New York, New York or any other court of competent jurisdiction for the breach or threatened breach of these Official Rules, without posting bond, in addition to any other remedies in law or equity, which may be available to the Releasees. Except where prohibited by law, each participant consents to jurisdiction and venue in the federal or state courts located in the City and County of New York, New York for the purposes set forth above and/or to confirm any award obtained by the Releasees in arbitration. If any part of this arbitration provision is deemed to be invalid or otherwise unenforceable or illegal, the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid or illegal provision were not contained herein, except that any such invalid or illegal provision shall be enforced to the greatest extent permitted by law. These provisions give you specific rights and you may have other rights under provincial laws.
